Article 1 (Application)
These Terms apply to all relationships between Users and the Service operator regarding the use of this Service.
Article 2 (User Registration)
Those wishing to use the Service must agree to these Terms and apply through a method we provide, including email/password or an external Apple or Google account. Registration is completed when we approve the application.
Article 3 (Account Information Management)
- Users registered via email/password must appropriately manage their passwords at their own responsibility.
- Under no circumstances may passwords be transferred or lent to third parties.
- Users registered with an Apple or Google account must manage that account appropriately in accordance with the provider's terms.
Article 4 (Usage Fees and Payment)
The Service offers three consumer plans: Free, Standard, and Pro. The principal limits are listed below. The price, currency, taxes, billing period, and purchase terms shown in the app store before confirmation apply to each purchase.
- Free: 3GB, 5 owned albums, 2 owned groups, 100 photos and 3 videos per album, up to 2 minutes per video, and 4 members per group
- Standard: 50GB, 50 owned albums, 10 owned groups, 1,000 photos and 50 videos per album, no plan-level video-duration limit, and 30 members per group
- Pro: 200GB, unlimited owned albums and groups, 3,000 photos and 200 videos per album, no plan-level video-duration limit, and 100 members per group
- Paid plan fees shall be paid through In-App Purchase provided by Apple Inc. (App Store) or Google LLC (Google Play). The terms of use of the respective app stores apply.
- Paid plans renew automatically. To stop renewal, cancel in the subscription management screen of the App Store or Google Play used for the purchase by the deadline specified by that store. Paid benefits remain available until the current subscription period ends.
- Free provides 3GB of storage indefinitely at no charge. If a storage or item limit is exceeded, existing data is not immediately deleted and may still be viewed, downloaded, commented on, or deleted, but new creation and uploads are restricted until usage is within the applicable limits.
- When uploading to shared albums, that storage capacity is consumed from the album owner's storage capacity. When other users who joined via a group or album share link upload photos or videos, that storage is also counted against the owner's capacity (the group owner for albums linked to a group).
- When a paid period ends, the account moves to Free. The timing, proration, and refund treatment of changes to a plan, billing period, or price are governed by the app store used for the purchase.
- Deleting the app or a PashaLog account does not cancel an app-store subscription. The subscription must be canceled separately through the app store used for the purchase.
Article 5 (Data Storage and Management)
Users are responsible for maintaining any necessary backup of photos, videos, and other data ("Content") uploaded to the Service. Except where caused by our intent or gross negligence, we are not liable for loss or damage caused by outages, user actions, or other events. Existing Content is not immediately deleted solely because of a plan change or exceeded limit.
When an album, group, or account is deleted, associated Content cannot be restored and is deleted in sequence through our systems. Album and group invitation links are valid for 7 days after issuance.
Article 6 (Prohibited Activities)
Users may not engage in the following activities when using this Service:
- Activities that violate laws or public order and morals
- Activities related to criminal acts
- Activities that infringe copyrights, trademarks, or other intellectual property rights contained in the Service content
- Uploading copyrighted works of others without the rights holder's permission
- Posting obscene, violent, discriminatory, or other content that causes discomfort to third parties
- Activities that destroy or interfere with our company's servers or network functions
- Activities to collect or accumulate personal information about other users
- Impersonating other users
- Unauthorized use of invitation links or tokens, or accessing an album or group without another user's permission
- Activities that directly or indirectly provide benefits to anti-social forces in connection with our company's services
Article 7 (Suspension of Service)
Our company may suspend or interrupt all or part of the Service without prior notice to Users if any of the following reasons are determined:
- When performing maintenance or updates on the computer systems related to this Service
- When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
- Other cases where our company determines it is difficult to provide the Service
Article 8 (Usage Restrictions and Deregistration)
Our company may restrict all or part of the Service usage or deregister the User without prior notice if the User falls under any of the following:
- When any provision of these Terms is violated
- When false information is found in registration information
- Other cases where our company determines the use of this Service is inappropriate
Article 9 (Disclaimer)
Except where liability cannot lawfully be excluded, we are not liable for damage not caused by our intent or gross negligence. Transactions, communications, or disputes between Users and other users or third parties should be resolved by those parties. Nothing in these Terms excludes or limits liability where applicable law prohibits doing so.
Article 10 (Changes to Service Content)
We may change or discontinue the Service when reasonably necessary for improvement, maintenance, legal compliance, or other operational reasons. Except in an emergency, material changes or discontinuation that significantly disadvantage Users will be announced in advance through the app or another appropriate method.
Article 11 (Changes to Terms)
We may change these Terms where reasonable in light of the need for and substance of the change and other relevant circumstances. We will announce the revised terms and effective date before they take effect. Where applicable law requires consent, we will obtain it through the method we specify.
Article 12 (Governing Law and Jurisdiction)
Japanese law shall govern the interpretation of these Terms. In the event of any dispute regarding this Service, the Tokyo District Court shall have exclusive agreed jurisdiction.
If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, nothing in these Terms excludes or limits your statutory rights under the laws of your country of residence.
Article 13 (Handling of User Generated Content)
This service prohibits the posting of inappropriate content (UGC) such as images or comments posted by users. Inappropriate content includes pornography, violence, discrimination, defamation, etc.
- We reserve the right to delete inappropriate content without prior notice.
- Users can report inappropriate content or users using the reporting function. Upon receiving a report, we will confirm the content and take appropriate measures (deletion of content, suspension of user account, etc.).
- Users can hide unpleasant users using the block function.
